Terms & Conditions
1. Introduction
These Terms and Conditions apply to all legal services provided by NRM Litigation Lawyers (“we”, “our”, “us”) to our clients (“you”, “your”). By instructing us, you agree to these Terms in addition to any costs disclosure and costs agreement we provide to you under the Legal Profession Uniform Law (Victoria) (“LPUL”).
2. Scope of Services
We will provide legal services as agreed with you in writing (e.g. letter of engagement, costs agreement, or subsequent instructions). We do not provide financial, accounting, or other professional advice unless expressly stated.
3. Costs Disclosure and Billing
We will provide you with a written costs disclosure and costs agreement in accordance with the LPUL.
Our fees may be charged on an hourly basis, fixed fee, or other basis as agreed.
You agree to pay our invoices by the due date stated. Interest may be charged on overdue amounts in accordance with the LPUL.
4. Trust Money
Any money we receive from you on account of costs or disbursements will be held in our trust account in accordance with the LPUL and the Legal Profession Uniform General Rules 2015.
5. Your Responsibilities
You agree to:
Provide us with timely, complete, and accurate instructions.
Respond promptly to our communications.
Pay our fees and disbursements in accordance with our invoices.
6. Confidentiality and Privacy
We will keep your information confidential, subject to our professional and legal obligations. We will handle your personal information in accordance with the Privacy Act 1988 (Cth) and our privacy policy.
7. Limitation of Liability
Our liability is limited by a scheme approved under Professional Standards Legislation. You may obtain a copy of the scheme from the Victorian Legal Services Board + Commissioner.
8. Termination of Services
Either you or we may terminate our engagement by written notice, subject to our professional obligations. You must pay for all legal work done and disbursements incurred up to the date of termination.
9. Communications
We may communicate with you by email or other electronic means. You acknowledge that electronic communication may not always be secure or free from error.
10. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes are subject to the jurisdiction of the courts of Victoria.
